These Terms of Service ("Terms") govern your purchase, installation, and use of the RecapWP WordPress plugin ("the Plugin"). The free version is distributed under the GNU General Public License v2 or later (GPL). These Terms govern the commercial Pro license and your relationship with us, and apply in addition to the GPL where relevant.
Agreement to Terms.
By using RecapWP — free or Pro — you agree to these rules. The free version is also under the GPL; these Terms apply on top of that for the Pro license.
By purchasing, downloading, installing, or using RecapWP ("the Plugin"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Plugin.
These Terms apply to both the free version of RecapWP and the Pro license. The free version is distributed under the GNU General Public License v2 or later (GPL). These Terms govern the commercial Pro license and your relationship with us, and apply in addition to the GPL where relevant.
License grant.
Pro is per-site. One license = one WordPress installation. Agencies can use a license on a client's site, but you remain the account holder. Keys are not for sharing or reselling.
RecapWP Pro is sold as a per-site commercial license. Upon purchase, we grant you a non-exclusive, non-transferable license to activate and use the Pro features of the Plugin on one (1) WordPress installation.
Your Pro license key is personal to you. You may not share, sell, sublicense, or transfer your license key to any third party. Each additional WordPress installation requires a separate license.
If you are a web developer or agency, you may use your license key on a WordPress installation owned or operated by a client, provided you remain the primary account holder responsible for that license. You are responsible for ensuring your clients comply with these Terms. If the client relationship ends, the license key must either be transferred to a new license purchased by the client or deactivated — it may not be reused on another site.
The underlying Plugin code is distributed under the GPL and you retain all rights afforded to you under that license, including the right to modify and redistribute the code. These Terms govern the commercial license key and Pro feature access only — not the GPL-licensed code itself.
Permitted use.
Use it on sites you own or manage. Don't share license keys, don't try to bypass license checks, and don't use it to do anything illegal.
You may use RecapWP to collect data from WordPress installations you own or are authorised to manage, and to generate automated reports on behalf of yourself or your clients. You may not:
- Share, sell, or transfer your Pro license key to another person or organisation
- Use the Plugin to collect or process data from sites you do not own or are not authorised to manage
- Use the Plugin in any way that violates applicable law or regulation, including data protection laws
- Attempt to circumvent or disable the license verification system
Intellectual property.
Plugin code is GPL — you can modify and redistribute it. The name, logo, website, docs, and branding are ours and not GPL. Don't ship a fork using our name.
The RecapWP name, logo, website, documentation, and all associated marketing and design materials are the exclusive property of RecapWP and its operator. Nothing in these Terms transfers any intellectual property rights to you. Your license grants the right to use the Plugin — it does not convey any ownership interest.
The Plugin code is distributed under the GPL. All other materials — including this website, documentation, and marketing content — are proprietary and may not be copied, reproduced, or redistributed without prior written permission.
The RecapWP name, logo, and trademarks are proprietary and are not covered by the GPL. While you are legally permitted to fork and redistribute the Plugin code under the GPL, you may not use the RecapWP name, logo, or any of our branding or marketing materials in any commercial redistribution or forked version of the software without explicit prior written permission.
Payment & billing.
$79 USD per site per year, billed annually by Lemon Squeezy. They handle taxes. Cancel auto-renew anytime in the Lemon Squeezy customer portal — cancellation takes effect at the end of the period you paid for.
Pro licenses are priced at $79 USD per site per year. All payments are processed by Lemon Squeezy, who acts as our merchant of record. By completing a purchase you also agree to Lemon Squeezy's Terms of Service.
Lemon Squeezy calculates and remits applicable taxes (including VAT and sales tax) based on your billing location. The price displayed at checkout is the total amount you will be charged.
Licenses renew automatically on an annual basis. Lemon Squeezy will send a renewal reminder email to the address on file before your license expires. You may cancel auto-renewal at any time through your Lemon Squeezy customer portal. To prevent the next annual charge, you must cancel before your renewal date. Following cancellation, your license will remain active until the end of the current paid billing period and will not renew. Cancellation does not entitle you to a refund for any portion of the current billing period unless the request falls within the 14-day refund window described in Section 6.
Refund policy.
Full refund within 14 days of your first purchase, no questions asked. After that, no refunds. Renewals aren't refundable. Email hello@recapwp.com with your order number.
We offer a 14-day money-back guarantee on initial purchases. If you are not satisfied with RecapWP Pro for any reason, contact us within 14 days of your original purchase date and we will arrange a full refund. Refund requests submitted after 14 days cannot be honoured.
Refunds apply to initial purchases only and do not apply to annual renewals. Because payments are processed by Lemon Squeezy, all refunds are issued by Lemon Squeezy and may take 5–10 business days to appear depending on your payment method. Updates & support.
A Pro license gets you 1 year of updates. After expiry the plugin keeps working but stops getting new features and security patches. Support is via email, best-effort, no SLA.
A Pro license includes access to plugin updates for one year from the date of purchase. After your license expires, the Plugin will continue to function but will no longer receive feature updates or security patches until the license is renewed. We strongly recommend keeping an active license to receive security-related updates.
Support is provided on a best-effort basis via email at hello@recapwp.com. We make no guarantee of any specific response time. Support is provided in English only.
Service availability.
The plugin runs on your WordPress install. We can't guarantee your hosting, your email deliverability, or third-party API uptime. Keep your environment on WordPress 6.2+ and PHP 8.0+, and test updates in staging first.
RecapWP runs entirely within your own WordPress installation. Data collection and report delivery depend on WP-Cron, your hosting environment's ability to send outgoing email, and any third-party APIs you choose to configure. We have no control over your hosting environment, email deliverability, or third-party API availability. We do not guarantee uninterrupted operation, successful report delivery, or the accuracy of any data returned by third-party services. We are not liable for any missed or failed reports caused by factors outside our control.
We are not responsible for any compatibility issues arising from future updates to the WordPress core software, PHP, or any third-party plugins or themes installed on your site. It is your responsibility to maintain a hosting environment compatible with the Plugin's stated requirements (WordPress 6.2 or higher; PHP 8.0 or higher). We strongly recommend testing updates in a staging environment before applying them to a live site.
Disclaimer of warranties.
The Plugin is provided as-is. No warranty it'll work for your specific use case, be error-free, or run without interruption. You use it at your own risk.
IMPORTANT: Please read this section carefully. It limits the warranties we make about the Plugin.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RECAPWP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLUGIN WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT ALL DATA COLLECTED WILL BE COMPLETE OR ACCURATE, OR THAT REPORT DELIVERY WILL OCCUR WITHOUT INTERRUPTION OR DELAY. YOUR USE OF THE PLUGIN IS ENTIRELY AT YOUR OWN RISK.
Limitation of liability.
If something goes wrong, our liability is capped at what you paid us in the past 12 months (or $10 USD if you're on the free version). No indirect or consequential damages.
IMPORTANT: Please read this section carefully. It limits the remedies available to you in the event of a dispute.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECAPWP AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLUGIN, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE TOTAL AMOUNT YOU PAID FOR YOUR RECAPWP LICENSE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS, OUR MAXIMUM LIABILITY SHALL BE $10 USD.
Indemnification.
If your use of the Plugin gets us in trouble — you violated these Terms, broke a law, or mishandled someone's data — you cover the costs.
You agree to indemnify, defend, and hold harmless RecapWP and its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Plugin in violation of these Terms; (b) your violation of any applicable law or the rights of any third party; or (c) any data you collect, store, or transmit using the Plugin. This indemnification obligation survives the termination of these Terms.
Dispute resolution.
Email hello@recapwp.com first and give us 30 days to fix it. If we can't, then courts.
Before filing any legal claim against us, you agree to first contact us at hello@recapwp.com and give us a reasonable opportunity — no less than 30 days — to resolve the issue informally. We will make good-faith efforts to reach a resolution. Most concerns can be addressed quickly this way.
If we are unable to resolve the dispute informally, either party may pursue their rights through the courts as set out in Section 14 below.
Termination.
We can terminate immediately for serious breaches (sharing keys, bypassing license checks, illegal use). You can cancel anytime in the Lemon Squeezy portal — your license stays active through the period you paid for.
We reserve the right to suspend or revoke your license immediately and without prior notice or refund if you materially breach these Terms, including but not limited to sharing your license key, circumventing license verification, or using the Plugin in a manner that violates applicable law. We will notify you of the termination as soon as reasonably practicable after the fact.
You may cancel your subscription at any time by disabling auto-renewal in your Lemon Squeezy customer portal. Your license remains active until the end of the current billing period. No partial-period refunds are issued unless the cancellation request falls within the 14-day refund window.
Governing law.
New York law. Courts in New York.
These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in New York, USA, and you hereby consent to the personal jurisdiction of those courts.
General provisions.
Standard boilerplate: these Terms + the Privacy Policy are the whole agreement; if one part is unenforceable the rest still applies; us not enforcing a right doesn't waive it; you can't assign your rights without our OK.
15.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecapWP regarding your use of the Plugin and supersede all prior agreements, representations, or understandings, whether written or oral.
15.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
15.3 No waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of RecapWP.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time without notice, including in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of our assets.
15.5 Survival
Sections 4 (Intellectual Property), 6 (Refund Policy), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 12 (Dispute Resolution), 13 (Termination), and 14 (Governing Law) shall survive the expiration or termination of these Terms.
Data processing & GDPR.
The Plugin runs on your server. We don't see your data or your visitors' data. GDPR compliance on the data the Plugin handles is your responsibility.
RecapWP operates entirely within your WordPress installation. We do not have access to your site's visitor data or the personal data of your users. You are solely responsible for ensuring your use of the Plugin complies with applicable data protection laws, including the GDPR where applicable.
Changes to these Terms.
We'll update the "Last updated" date at the top. For material changes we'll email active license holders before they take effect. Keep using the Plugin = you accept the update.
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify active license holders by email before the changes take effect. Continued use of the Plugin after revised Terms are posted constitutes your acceptance of the updated Terms.
